GENERAL TERMS AND CONDITIONS
Object
The object of these General Terms and Conditions is the purchase of products and services, from a remote place thru Internet on web site www.numaworld.it, owned by to FATAR s.r.l., whose registered office is in Recanati (MC) – Italy – Zona Industriale Squartabue.
Each purchasing transaction is regulated under provisions of Law by Decree 185/99 and subject to regulations Law 675/96 and following amendments, as to privacy protection.
Acceptance of general conditions of selling
By the telecom-confirmation of his purchasing order, Customer will unconditionally accept and – as far as his relations with FATAR s.r.l., hereafter called FATAR, are concerned - bind himself to comply with general terms and conditions, and conditions of payment hereafter written in details, and declare having looked over and accepted all dictations supplied under the laws here above mentioned and confirm having taken note that FATAR doesn’t consider themselves bound by conditions other than those previously agreed in writing.
Customer’s obligations
• These General Conditions of Sale have to be carefully examined on line by Customer visiting the web site www.numaworld.it before he releases his purchase confirmation. Such a purchase order confirmation means the full acknowledge of General Conditions of Sale and their full acceptance.
• Customer commits and obliges himself, once an on line transaction is completed, to print and keep these General Conditions of Sale, already examined and accepted during the purchasing process, in full compliance with art. 3 and 4 of Law by Decree 185/99.
Modalities of purchase
• The purchase of products, available as illustrated and described in the relevant descriptions and technical cards, is effected by Customer at the price therein indicated, to be contextually reconfirmed at the time of the order confirmation, increased by the relevant taxes, customs’ fees and delivery charges as hereafter specified in these General Conditions of Sale and, in any case, put in evidence when purchasing.
• Before receiving the final sale confirmation, Customer will be recapitulated with unitary price for each item purchased, total value (case more than one item is purchased), and delivery charges.
• Customer will be charged with all relevant taxes and customs’ fees and duties.
• After confirming the purchase and as completion of the transaction, Customer will receive an e-mail containing the number, the date, the total amount of his order. Case payment is effected by bank transfer. Customer will also receive the details and instructions for payment.
Payments
Payment of purchases and relevant taxes and delivery charges will be effected by Customer when sending his order confirmation by mean of advance Bank Transfer.
Payment by Bank Transfer
• Bank Transfer (T.T.) is to arrive in advance and a copy is to be sent by fax to the number indicated on the sale confirmation by FATAR, otherwise order confirmation will be considered as null and void.
Reason for payment is to accompany the transfer and has to indicate:
- number and date of order
- applicant’s name and family name
- beneficiary’s coordinates, which are:

Bank coordinates are indicated on the sale confirmation.
Delivery
Purchased products are delivered to the address indicated by Customer. Each delivery includes purchased products. It is not included any invoice. Deliveries will take place during all working days. Deliveries can be effected by lots, without that implying any responsibility for FATAR.
In case of loss or missing deliveries, FATAR is responsible just for deliveries by couriers.
Before accepting goods, customer is owed to check that package is complete, undamaged, not wet.
Guarantees
• Purchases effected thru www.numaworld.com are subject to regulations, as much as they are enforceable, of Law by Decree 24 dated 02.02.2002 (Official Gazette 57, dd 08.03.2002) about Contracts of Sale and Guarantees on Consumables and, as for what not therein contemplated, to specific provisions on the matter regulated by Civil Code.
The guarantee is applicable to products presenting imperfections or defects in conformity or malfunctioning at the moment of purchase, provided that product is used properly, correctly and carefully, i.e. respecting its obvious use and what foreseen in the technical cards and in compliance with dictations therein indicated.
• The guarantee is not applicable in case of negligence and carelessness in use and maintenance, of connection to electrical systems, or any kind of connection, against regulations. The guarantee is personal, is addressed to customers and not to retailers, and will be applied to the original buyer.• The malfunctioning has to be noticed by customer within 10 days from receipt of goods delivered. A written communication has to be attached to the malfunctioning product sent back. FATAR will refuse substitution for products that, even if malfunctioning, are not sent back in their original packages, with all the documents, or not equipped with all their accessories and/or instructions handbook, if/when any, or any other element originally included.

• FATAR can check the real malfunctioning of the products, as reported by customer, and will proceed with substitution only after fault test.
• The substitution will be done only if in the package sent back there are the following documents:
- number and date of order
- description of the manufacturing fault
- serial number.
• Shipping costs are charged to the customer.
Right of withdrawal
The online sale of physical assets by the Group FATAR (www.numaworld.it through the portal) to its customers is governed by last Italian legislation in force relating to the sail by mail order with a right of withdrawal.
According to and within limits of Law by Decree n. 185 dated May 22, 1999, Customer (is with no business aims, nor purchase with VAT number) is entitled to exercise his right of Withdrawal for any reasons, without giving explications and without penalties, in the manner and in the following terms:
Customer is entitled to exercise his right of Withdrawal within 10 working days from receipt of goods delivered by registered letter with return receipt or fax/telegram/e-mail - reconfirmed by registered letter, within the following 48 hours – to the followings:

Once received the registered letter, FATAR Costumer Service will provide a communication with the manners to send the goods back within 10 days.
Customer is entitled to exercise his right of Withdrawal for in the manner and in the following terms:
• If goods are bought wholly.
• If goods are not opened.
• FATAR will refuse products not returned free of expenses or encumbered by delivery charges not fully paid by Customer; or in case Customer has not acted in accordance with modalities and terms regulated by art. 5 of Law by Decree 185/99 as to notification of right of withdrawal, or in case products aren’t sent back in their original packages or not equipped with all their accessories and/or instructions handbook, if/when any, or any other element originally included.
• In order to limit damages to the original package, we suggest to use, as it is possible, an additional package.
• Shipping costs are charged to the customer and are not refundable under any circumstances.
• In any case, charges borne for returning products are to be on Customer account.
• The Client is responsible for loss or damage of goods delivered.
• In case of damage of goods delivered during transportation, FATAR will provide communication to the client within 5 working days from receipt of goods delivered, in order to allow the client to report quickly the damage and obtain the value of the good back, if it is insured. In this case the goods will be at client’s disposal and the right of withdrawal will be temporary annulled.
• FATAR is not responsible for damage, loss or theft of not insured shipments.
• In the event that the anomaly reported there at the time of shipment will be charged a flat rate of 10% of the repayment of amounts paid.
FATAR will provide for crediting back to Customer the value of products subject of the claim within and not latest than 30 working days after receiving back products subject of the claim. The yield on the commodity (calculated net of transportation costs) will be sent to the customer by bank transfer. In this case, the client will provide quickly his bank coordinates.
The right of withdrawal decays for missing condition of goods integrity (package and goods) when FATAR certifies that the damage of goods is not due to transportation. FATAR will provide to send the goods beck to customer and charges borne for returning products are to be on Customer account.

Place of jurisdiction
This contract is subject to and regulated by the Italian Law. For controversies, if any, related to validity, interpretation, execution, fulfilment of this contract the venue is of the Court of Macerata.
